Private email accounts 'subject to FOI'

The Information Commissioner's Office (ICO) has published new guidance making it clear that information concerning official business held in private email accounts is subject to the Freedom of Information Act.

The organisation published the guidance on the issue after investigating education secretary Michael Gove and some of his closest advisors after evidence emerged in September that they had used private emails to conduct government business.

Emails sent between Mr Gove and senior aides suggested that discussions were taking place through personal Gmail accounts instead of official channels, meaning that official emails were hidden from staff trying to respond to an FOI request.

Christopher Graham, the information commissioner, said: "It should not come as a surprise to public authorities to have the clarification that information held in private email accounts can be subject to Freedom of Information law if it relates to official business.
